If Client’s service includes Market Data provided by Chi-X (“Chi-X Market Data”), the following additional terms apply:

1. Client agrees to use commercially reasonable efforts at all times to identify Chi-X as the source of the Chi-X Market Data.  Without limitation, any reference in the Chi-X Market Data to any trademark of Chi-X by Client shall acknowledge Chi-X’s rights in such mark as follows: ““Chi-X®” is a registered trade mark of Chi-X Europe Limited, a company with registered number 1651728 whose registered address is 26th Floor, 25 Canada Square, Canary Wharf, London, E14 5LQ and may only be used under licence from Chi-X.  Chi-X Data is the property of Chi-X.” Chi-X shall own any and all rights including without limitation Intellectual Property rights and any and all goodwill arising directly or indirectly out of Client’s use of the “Chi-X®” trade mark.
